This is the English translation of the user agreement for the version of MiaoYan AI Keyboard downloaded from our official website (miaoyanzhixin.com / miaoyan.co, including the Diệu Ngôn edition). The Chinese version at /terms.html prevails in case of any inconsistency. The version distributed on Google Play is governed by miaoyan.co/terms-en.html.

This Agreement is entered into between you and Shenzhen Chainfun Technology Co., Ltd. ("we", "us") regarding the MiaoYan AI Keyboard software and related services (the "Service"). Please read all terms carefully before using the Service. Terms that exclude or limit our liability, the explanation of the nature of AI-generated content, and the dispute resolution terms are shown in bold; please read them with particular care.

By downloading, installing, enabling or using the Service, you confirm that you have read, understood and agree to be bound by this Agreement. If you do not agree with any part of this Agreement, please stop using and uninstall the Service immediately.

1. Scope and changes

• This Agreement consists of the main text and all rules we have published or may publish in the future, which form an integral part of this Agreement.
• We may revise this Agreement when necessary. After a change, we will notify you through in-app notices, the updated date, or similar means. If you continue to use the Service after a change, you are deemed to accept the revised Agreement.
• Our handling of your personal information is governed by the MiaoYan AI Keyboard Privacy Policy, which has the same effect as this Agreement.

2. The Service

The Service is an AI-assisted keyboard for chatting. Its features include, but are not limited to: AI smart reply suggestions, text polishing, screen scanning, speech-to-text and ice-breaker topic suggestions.

The specific features, interface and availability of the Service depend on the version of the software you actually use. We may add, adjust or retire some features as the product evolves.

3. Account registration and security

• Some features require an account. You should register with a phone number you lawfully hold and ensure your registration information is true and accurate.
• You must keep your account and verification codes safe. You are responsible for any account leak, misuse and resulting losses caused by your own actions.
• You can delete your account via "Settings → Account security → Delete account". After deletion, your account and associated data are permanently deleted and cannot be recovered, and any purchased but unused benefits are forfeited, so please proceed with care.
• You may not rent, lend, transfer or sell your account, or allow anyone else to use it in any way.

4. Membership and paid services

• Some features are paid membership benefits. Membership types, prices, billing periods and included benefits are as shown in the app or on the app store page at the time of purchase.
• Payment, renewal and refunds for purchases made through the Apple App Store, Google Play or other third-party app stores are governed by that app store's rules; please submit refund requests through the relevant app store.
• If auto-renewal is enabled, you can turn it off at any time in the relevant app store's subscription settings. If you do not turn it off before the current period ends, it will renew automatically under that store's rules.
• Membership benefits are for your personal use only and may not be transferred. If the Service is suspended or terminated because you breached this Agreement, fees already paid will not be refunded.

5. Rules of conduct

You agree not to use the Service to:

• Create, copy, publish or spread content prohibited by laws and regulations, including but not limited to content that endangers national security, undermines social stability, or involves obscenity, pornography, gambling, violence, terrorism or incitement to crime;
• Infringe the reputation, privacy, intellectual property or other lawful rights of others;
• Commit telecom or online fraud, harassment, abuse or personal attacks, or pursue any deceptive purpose;
• Use cheats, scripts, crawlers or automated tools to call the Service in bulk, or interfere with or disrupt the normal operation of the Service in any way;
• Reverse engineer, decompile or disassemble the Service, or attempt to obtain its source code;
• Engage in any other conduct that violates laws, regulations, public order and good morals, or this Agreement.

If you violate these rules, we may, depending on the circumstances, issue a warning, restrict features, or suspend or terminate the Service, and we reserve the right to pursue legal liability.

6. About AI-generated content (important)

• The AI reply feature is provided by calling third-party large-model APIs. Its output is probabilistic and uncertain and may be inaccurate, incomplete, outdated or even wrong.
• All AI-generated content is a suggestion only and does not constitute any professional advice (including but not limited to legal, medical, financial or investment advice). Whether to adopt, edit or send it is entirely your own decision, and you bear the consequences.
• You must ensure that your use of content generated through the Service does not infringe the lawful rights of any third party. You are responsible for any dispute, loss or liability arising from your use or sending of AI-generated content.
• We make no express or implied warranty as to the truthfulness, accuracy or completeness of AI-generated content.

7. Intellectual property

• The intellectual property in the Service's software, trademarks, interface design, text, graphics and other elements belongs to us or the relevant rights holders. You may not copy, modify, distribute, display or otherwise use them without written permission.
• Rights in the original content you enter through the Service belong to you. You understand and agree that, as necessary to provide the Service to you, we process such content within the scope set out in the Privacy Policy.

8. Changes, interruption and termination of the Service

• We may suspend or terminate all or part of the Service for business adjustments, technical upgrades, equipment maintenance or similar reasons, and will make reasonable efforts to give advance notice.
• We are not liable for service interruptions caused by force majeure, network failures, interruptions of third-party services (including large-model APIs, SMS and speech recognition) or government action.
• You may stop using and uninstall the Service at any time.

9. Disclaimer and limitation of liability

• The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranty that the Service is fit for purpose, error-free or uninterrupted.
• To the maximum extent permitted by law, we are not liable for any indirect loss, loss of profit, loss of data or loss of goodwill you suffer from using the Service; our total liability shall not exceed the total fees you actually paid for the Service in the twelve months before the claim.
• This section does not exclude or limit any liability that cannot be excluded or limited by law.

10. Minors

The Service is intended mainly for adults. If you are a minor, please read this Agreement together with your guardian and use the Service only with your guardian's consent. Users under 14 must use the Service under the guidance of a guardian. Guardians may exercise the relevant rights through the contact details below.

11. Governing law and dispute resolution

• The conclusion, validity, interpretation, performance and dispute resolution of this Agreement are governed by the laws of mainland China (excluding conflict-of-law rules).
• Disputes arising from this Agreement should be resolved through friendly negotiation; if negotiation fails, either party may bring a lawsuit before the People's Court of Nanshan District, Shenzhen.
• If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in effect.
